Subject: Resolution authorizing renewal of the Memorandum of Agreement (MOA) with Department of Transportation to reimburse the City for maintenance of non-landscaped portion of Hwy 441.

Staff Recommendation:

Staff recommends approval of Memorandum of Agreement (MOA) with Department of Transportation to reimburse the City for maintenance of non-landscaped portion of Hwy 441 from College Drive to CR473/Bluegill Drive.

Analysis:

On September 28, 2009, the City Commission approved a three year contract with FDOT to receive reimbursement of funds for maintenance of the non-landscaped portions of that roadway which is primarily grassy areas of Bahia grass. The $9,156.00 is the amount FDOT would pay a contractor to maintain the same area. The three year period of this contract will expire in November, 2012.

The FDOT sent the renewal contract with a revision increase of 8.3% resulting in reimbursements of $9,919.00 annually. This contract will be for another three year term.

Options:

1. Approve renewal of Memorandum of Agreement with Florida Department of Transportation or;

2. Such alternative action as the Commission may deem appropriate

Fiscal Impact:

Approval of the MOA will provide reimbursement of $9,919.00 annually for non-landscaped maintenance of Hwy 441 for the three year period. The proposed fiscal year 12-13 includes this revenue and associated expenses.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE RENEWAL OF THE MEMORANDUM OF AGREEMENT (MOA) WITH DEPARTMENT OF TRANSPORTATION TO REIMBURSE THE CITY FOR MAINTENANCE OF NON-LANDSCAPED PORTION OF HWY 441 FROM COLLEGE DRIVE TO CR 473; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

THAT the Mayor and City Clerk are hereby authorized to execute renewal of Memorandum of Agreement with the Department of Transportation whose address is 1450 Thomas Ave, Leesburg, Florida 34748 for reimbursement of $9,919.00 to provide maintenance portions of Hwy 441 and mutually agreed upon renewals or extensions.

The term of this renewal agreement shall be for an additional three year term. The renewal contract received from FDOT had a revision increase of 8.3% in reimbursements which resulted in an increase of $763.00 from initial agreement.

THAT this resolution shall become effective immediately.
