Staff Recommendation:
Staff
recommends adoption of the resolution which will reduce rates for the
stormwater utility by $0.50 per Equivalent Residential Unit (ERU), or
approximately 8.3%.
Analysis:
During
the budget workshops, staff presented an analysis of stormwater revenues and
expenses. Primarily because of the
utility’s success in obtaining grants for stormwater capital construction
projects, the fund balance has grown in recent years. Projections of revenues and expenses over the
next five years show that the stormwater utility rates can be reduced, while
still providing sufficient revenues to fund operations, capital projects and
repair and replacement projects.
Therefore,
staff recommended a reduction in stormwater utility rates. The Commission reached a consensus to accept
staff recommendation. Should this
resolution be adopted, it will enact the rate reduction recommended by staff.
Options:
1. Approve the resolution establish the new rate
structure for the stormwater utility; or,
2. Such alternative action as the Commission may
deem appropriate
Fiscal Impact:
The
resolution will reduce stormwater utility rates by $0.50 per ERU, or
approximately 8.3%. The estimated annual
reduction in revenues is approximately $100,000. The projected fund balance will remain stable
throughout the five-year projection.

A
RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA,
ESTABLISHING NEW RATES FOR THE STORMWATER UTILITY PURSUANT TO §22 – 354 OF THE
CODE OF ORDINANCES; REPEALING RESOLUTION NO. 7384 ADOPTED ON JULY 11, 2005,
WHICH ESTABLISHED THE FORMER RATES FOR THE STORMWATER UTILITY, AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the
City of Leesburg has established a Stormwater Utility and levies a fee to fund
its operations, and
WHEREAS,
22 – 354 of the Code of Ordinances provides that the amount of the
Stormwater Utility fee is to be set by resolution, and
WHEREAS,
the City now desires to adjust the rates for its Stormwater Utility fees,
NOW
THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG,
FLORIDA:
SECTION I.
Effective
as of October 1, 2012, for any statements rendered on or after that date, the
rates for the Stormwater Utility fees shall be as follows:

SECTION II.
Resolution No.
7384, adopted on July 11, 2005, which established the Stormwater Utility rates
in effect prior to adoption of this Resolution, is hereby repealed effective as
of midnight on September 30, 2012.
SECTION III.
This Resolution shall take effect upon its passage and
adoption according to law.
