Subject:                      Resolution adopting an Amended Building Fire Fee Schedule

 

 

Staff Recommendation:

Staff recommends approval of the resolution for the proposed amended fee schedule (Exhibit A).

 

Background:

The current Building Permit fees were adopted by the Leesburg City Commission by resolution in 2008 as an amendment to the previous 2003 fees. During the last five plus years, most communities in Lake County have increased fees to cover the cost of providing building services whether they are done by in house staff or out sourced to private firms. Leesburg has not increased fees, but has opted to supplement the building fees through the General Fund at an average of $100,000 a year.

 

Analysis:

As presented at the Commission Budget Workshop on July 25, 2013, the staff’s approach to analyze fees was to obtain fee schedules from various cities adjacent Leesburg and other cities that have in house Building Services. The staff selected and reviewed current fees from other municipalities in addition to Leesburg’s fees and developed an Excel spread sheet to compare the fees for each jurisdiction. Also, information was gathered for each jurisdiction indicating their permit charges and fee formulas.  In the final analysis we looked at the fee structure for the cities of Fruitland Park, Mount Dora, Minneola, Eustis and Tavares. The fees for the selected cities were compared to the fees for City of Leesburg for actual permits issued for a single family residence, a restaurant, car dealership, and a retail convenience store. Based on the results of this analysis, staff developed a recommended draft fee schedule for review by city administration and consideration by the City Commission. To illustrate the proposed fees, staff developed a bar graph and applied the proposed fees to various types of actual projects in the city. As shown by the charts (Exhibits B), currently the City has the lowest building permit fees for the communities reviewed.

 

Recommendation:

Staff recommends fees as shown in the following Fee Schedule.  The proposed fees will provide adequate funding to operate the Building Division while keeping fees at one of the lowest levels in the county and will eliminate the $100,000 a year supplement from the General Fund. In addition, Option 2 will provide for a 20% reserve for the Building Division that is needed to pay back the General Fund and build a future reserve for the division similar to utility providers. Therefore, staff recommends approval of the proposed fee schedule per Option 2.

 

Options:

1.                  Approve the resolution for the revised fee schedule.

2.                  Approve the resolution for the revised fee schedule including a reserve of 20%.

            3.         Disapprove the resolution for the revised fee schedule.

 

Fiscal Impact

Approval of the proposed Fee Schedule will increase the revenues generated by the Building Division to cover the cost of providing building services and provide for a reserve fund. This will offset the supplement from the General Fund of approximately $100,000 a year.

A  RESOLUTION  OF  THE  CITY  COMMISION  OF  THE  CITY  OF LEESBURG,  FLORIDA, AMENDING THE BUILDING  PERMIT FEE SCHEDULE; REPEALING THE EXISTING BUILDING PERMIT FEE SCHEDULE ADOPTED VIA RESOLUTION NO. 8115; AND PROVIDING AN EFFECTIVE DATE.

 

WHEREAS, certain fees are necessary for processing of permits for Administrative Fees; Commercial Building Permit Fees; Residential Building Permit Fees; Mobile Home Fees; Permit Renewal Fees; Re-Inspection Fees; Sign Permit Fees; Swimming Pool Permit Fees; and Other Permit Fees in conjunction with Chapter 7 of the Code of Ordinances of the City of Leesburg, and

 

WHEREAS, Article II of Chapter 7 of the Code of Ordinances of the City of Leesburg requires that such fees are to be established from time to time, by the resolution of the City Commission;

 

NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Leesburg, Florida;

 

Section 1

That the existing schedule of building permit fees, previously adopted via Resolution No. 8115, is hereby repealed, and that in its place the City Commission does hereby adopt the attached EXHIBIT A, OPTION __, as the schedule of permit fees to be utilized within the City of Leesburg, which includes: Administrative Fees; Commercial Building Permit Fees; Residential Building Permit Fees; Mobile Home Fees; Permit Renewal Fees; Re-Inspection Fees; Sign Permit Fees; Swimming Pool Permit Fees; and Other Permit Fees.

 

THIS RESOLUTION upon its passage and adoption according to law shall become effective, October 1, 2013.

 

PASSED  AND  ADOPTED  at  the  regular  meeting  of  the  City  Commission  by  the  City Commission of the City of Leesburg, Florida, held on the 12th  day of August, 2013.
